ARTICLE 1: OBJECT
These Terms and Conditions of Use (the "Terms of Use") shall govern the
use of the services proposed by FantasyBucket located at www.fantasybucket.com and the
legal rights and obligations of the users (collectively, "The User").
Before using any services of the site, the User must read and accept
the FantasyBucket Terms of Use by clicking on << I accept the FantasyBucket Terms
of Use >>.
ARTICLE 2: DEFINITIONS
- User: All the persons that are registered with www.fantasybucket.com and who have free access to the Services.
- Visitors: All the persons that are not registered with the Site yet and who can't use the Services.
- Services: All the online applications that enable the User to post
content on the site such as text, graphics, images, sound or messages,
for which www.fantasybucket.com assures the storage.
ARTICLE 3: CONDITIONS OF REGISTRATION
The registration with the site is free and open to all schools' curriculums.
In order to become the member of the Site, one has to fill out the registration form beforehand.
When filling out the registration form, the User must acknowledge that
he will need to provide some personal information such as, name,
school, email, city, date of birth, that is in accordance to the
clauses of to the clauses of article 6 III-2 of the Law on Confidence
in the Digital Economy on 21 June 2004.
Attention: Users under the age of 13 years must have their registration
forms filled out and/or accepted by at least one parent or legal
guardian.
To accomplish this, the User's parent or legal guardian must accept the following clause :
”I certify that I am the legal guardian of the person who wishes to
register with the site and I clearly authorize the collection of his
personal information”.
The use and storage of this information is treated in accordance to the article 10 of this law.
In addition, the User will need to provide www.fantasybucket.com with his
professional position, his date of birth, sex and choose a username and
a password that will be required to sign in to the site and access FantasyBucket
services.
The User agrees to provide truthful and accurate information in the registration form.
Once these steps are completed, one has to click << Save my Profile >>.
If the information provided is correct, the User will receive an email
confirming that the registration was taken into account.
In order to validate the registration and activate the account, the
User will have to go to the URL sent by email by clicking on the
specified link.
Once the validation is complete, the User becomes a full member of the site and can begin using all of its Services.
ARTICLE 4: PERSONAL PAGE
FantasyBucket enables Users to send and receive messages on their personal page.
The personal page is an online tool of communication with the public
edited by the User where FantasyBucket doesn't exercise any control over the
content whatsoever.
Therefore it is the responsibility of the User who created the personal
page to supervise the content published on his personal page.
For this purpose, the User should be aware that alert links on the site are at his disposal.
The User is fully responsible for the messages he posts and
content he submits to his personal page and www.fantasybucket.com only takes the
responsibility for the storage.
As a consequence he has to act responsibly and to notably commit oneself:
-Not to publish on one's personal page or other personal pages messages
that are insulting, defamatory, containing pornographic or pedophilic
content, terrorist threats , crimes against humanity, promoting
violence or racism,
- Immediately delete all the messages of this nature that are posted on
the personal page and swiftly inform www.fantasybucket.com, through the links of
alerts that are at one's disposal on the site,
- Not to solicit any information that concerns the personal life of or contains personal information about other people,
- Respect the rights of others and notably the rights of authors,
- In all circumstances maintain moderate, polite and non-offensive language,
- Not to embrace subjects that are discriminatory against race, ethnicity or religion of other Users or of any person,
- Not to post messages that are of pedophilic or pornographic nature.
Finally, the User should be aware that when he posts a message on his
personal page or on the personal page of other User, his IP address is
automatically stored, pursuant to the clauses of article 6 II of the
South African Law on Confidence in the Digital Economy of 21 June 2004.
This personal information is used and stored in accordance to the
conditions stated in article 10, subject to the clauses of articles 6
II first line of paragraph 3 and 6 I-7 of the Law aforementioned.
The User can delete the message that he posts on his personal page at any moment by following the instructions on the Site.
Furthermore, in accordance to the provisions of article 6 I-7 of the
Law aforementioned, messages that are insulting, defamatory, containing
violence, pedophilic or pornographic content, justifying terrorist
threats or war crimes, crimes against humanity, promoting violence or
racism, when brought to the attention of www.fantasybucket.com, will be immediately
deleted and will be referred to the judiciary authorities.
The User, the author of this message, will be immediately expelled from the site and have his membership terminated.
ARTICLE 5: FORUMS
This area is meant to enable the User to contribute to the discussions proposed on the Site.
The User can freely converse in different sections of the forum.
The User should be aware that www.fantasybucket.com is not in a position to check
all the content of every message before its publishing and proceeds
only one kind of control a posteriori of them, by the means of
voluntary moderators placed in each section of the forum, who are in
charge of alerting the unlawful messages.
Therefore, the User is advised to respect at all times the principles
declared below that have value of a charter and that he explicitly
agrees by accepting the Terms of Use, the User commits:
-Not to post messages that are insulting, defamatory, containing
violence, pedophilic or pornographic, justifying terrorist threats or
war crimes , crimes against humanity, or promoting violence or racism,
- Immediately alert www.fantasybucket.com of all the messages of this nature that
are posted on the forum through the links of alerts that are put in
place on the site,
- Not to solicit any information that concerns the personal life of or contains personal information about other people,
- Respect the rights of others and notably the rights of authors,
- In all circumstances behave with respect towards the other Users. Be polite and non-offensive,
- Not to embrace subjects that are discriminatory against race, ethnicity or religion of other Users or any person,
- Contribute to the prevention of all the unlawful content and conduct interactions in a responsible and mature manner.
The User should be aware that when he posts a message on the forum, his
IP address is automatically stored, pursuant to the clauses of article
6 II of the Law on Confidence in the Digital Economy of 21 June 2004.
This personal information is used and stored in accordance to the
conditions stated in article 10, subject to the clauses of articles 6
II first line of paragraph 3 and 6 I-7 of the Law aforementioned.

aforementioned , messages that are insulting, defamatory, containing

brought to the attention of www.fantasybucket.com, will be immediately deleted and
will be referred to the judiciary authorities.
The User, the author of this message, will be immediately expelled from the site and his membership terminated.
ARTICLE 6: USE AND STORAGE OF PERSONAL INFORMATION
The
personal information collected pursuant to the article 3 of this law is
to enable the identification of the persons that wish to use the
services proposed by the Site.
In accordance to the clauses of the article 34 of the South African Law of 6
January 1978 modified by the law 6 August 2004, the User has the right
of access, modification, correction and deletion of his personal
information.
www.fantasybucket.com will store the provided information over the period that will
not exceed 3 years following the termination of the User's account.
In accordance to the article 6 III-2 of the South African Law on Confidence in
the Digital Economy of 21 June 2004, www.fantasybucket.com assures the privacy of
the provided information.
This obligation ceases in case of judiciary requisitioning.
The User should be aware that the site uses the navigation cookies that
save on the User's computer the information concerning the navigation
on the site that is transmitted to www.fantasybucket.com during the visit.
None of those cookies collect the personal information of the User.
The period of the cookies storage on the User computer can't exceed 3
months and the User can deactivate or delete the cookies at any time by
using the navigation options.
Once registered on the site, the user authorizes www.fantasybucket.com to send
information about promotional offers from partners by email. The user
keeps the possibility to opt-out of receiving promotional newsletters
at anytime.
ARTICLE 7: www.fantasybucket.com RESPONSIBILITIES
www.fantasybucket.com takes all
the necessary measures to assure the security of the User and, notably,
to pursue active policy preventing and deleting the unlawful content.
FantasyBucket commits:
- Put in place on the site alert links that enable the User to report
unlawful content and notably those, pointed at in the article 6 I-7 of
the Law on Confidence in the Digital Economy of 21 June 2004.
- Remove from the Site or make the access impossible of all the unlawful content that was brought to the Site's attention.
- Inform immediately the authorities of all the unlawful content
defined in the articles aforementioned that the Site will have
knowledge of.
However, as a host, www.fantasybucket.com is generally not obliged to supervise the content published on the Site.
The User is solely responsible for using the proposed Services and of the content he publishes on the Site.
www.fantasybucket.com is not responsible for the content published on the Site.
In like manner, www.fantasybucket.com is not responsible for the content published
on the other sites whose hypertext links are sent on the Site.
Furthermore, even if www.fantasybucket.com takes all the necessary measures to
assure the confidentiality of the information transmitted by the User,
it is not responsible (and will not be held liable) for the automatic
use of the information in case of the intrusion and, as a result,
disclosure of confidential information.
ARTICLE 8: USER RESPONSIBILITIES
The User commits to civil and criminal responsibility if he commits one of the actions mentioned below :
-Attempt to access the automatic data processing system,
-Abuse the rights of a third party and notably the rights of authors and ownership of their assets,
-Advocating violence and racial hatred,
-Libel, threats and offenses,
-Publishing images of pedophilic and /or pornographic nature,
-Justifying war crimes and /or crimes against humanity
-Provocation of suicide,
-Soliciting information about the personal life of another person,
-All actions that endanger the health, security and morality of a minor,
- False declaration of one's identity,
-Attempt to access the confidentiality of correspondence.
The User is reminded that in accordance to the clauses of articles
323-1, following the South African Penal Code, that intrusion and fraudulent
behavior in the automatic data processing system is punishable with a
penalty of 2 years in prison and 30,000 euros fine; deleting, modifying
and altering the data contained in this system or in its operation is
punishable with a penalty of 3 years in prison and 45,000 euros fine.
Additionally, if the aforementioned actions are committed by a minor,
the civil responsibility will be placed on his parents or legal
guardians.
ARTICLE 9: CHANGES TO THE TERMS OF USE
Updates to and
modifications of The present Terms of Use will be brought to the User's
attention by sending an email to the User.
Nonetheless the User should regularly consult the Terms of Use on his own initiative.
It is agreed, that these Terms of Use will be applicable to the User
continuing to use the proposed services on the Site, 30 days after
publishing them online. |
